1. Agreement to Terms

By accessing or using the website rightwaypool.com ("Site") or engaging our pool cleaning and maintenance services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or services. RightWay Pool ("we," "us," or "our") reserves the right to modify these Terms at any time.

2. Services

RightWay Pool provides residential and commercial pool cleaning, maintenance, and repair services in Jacksonville and St. Johns County, Florida. Our services include but are not limited to:

  • Weekly and bi-weekly pool cleaning and chemical maintenance
  • One-time pool cleaning and green pool recovery
  • Pool equipment repair and replacement
  • Water chemistry testing and balancing
  • Filter cleaning and salt system service

3. Service Agreements

Recurring pool service is provided on a month-to-month basis unless otherwise agreed in writing. Key terms:

  • No Long-Term Contracts: You may cancel recurring service at any time with 7 days written notice.
  • Service Schedule: We will service your pool on the agreed-upon day each week. Schedules may shift due to holidays or severe weather.
  • Access: You must provide safe, unobstructed access to your pool and equipment on service days. If access is not available, the visit will be counted as completed.
  • Pets: Please secure pets on service days for the safety of our technicians and your animals.

4. Pricing and Payment

  • Recurring service is billed monthly in advance. One-time services and repairs are billed upon completion.
  • Prices are subject to change with 30 days written notice for recurring services.
  • Chemicals necessary for standard service are included in the monthly rate. Specialty chemicals or excessive chemical use (e.g., severe algae treatment) may incur additional charges with prior notice.
  • Payment is due upon receipt of invoice. Late payments may result in service suspension after 15 days.
  • We accept major credit cards, ACH bank transfers, and checks.

5. Cancellation and Refunds

  • Cancel recurring service at any time with 7 days written notice via email or phone.
  • Prepaid service for the remaining portion of the current billing cycle will be refunded on a prorated basis.
  • One-time services that have been completed are non-refundable. If you are unsatisfied, we will re-service your pool at no additional cost.

6. Limitation of Liability

To the fullest extent permitted by Florida law:

  • RightWay Pool shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website.
  • Our total liability for any claim related to our services shall not exceed the amount paid by you for the specific service in question.
  • We are not liable for pre-existing equipment failures, structural defects, or damage caused by acts of nature (storms, freezing, etc.).
  • We carry general liability insurance and workers' compensation insurance for your protection.

7. Website Use

  • The content on our website is for general information purposes only and does not constitute professional advice.
  • You may not use our website for any unlawful purpose or in violation of these Terms.
  • All content, trademarks, and intellectual property on our website are owned by RightWay Pool and may not be reproduced without permission.

8. Customer Portal

If you are provided access to our customer portal, you are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate portal access at our discretion.

9. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Duval County, Florida, in accordance with Florida law. You agree to waive your right to a jury trial.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
